What remedies do i have if my landlord lost my rent money and it was paid in cash? |
my cousin and i rent from the same landlord. he paid is rent sunday, but he paid in cash that was put in an envelope with his name on it and the landlord was on vacation so he wasn't in the office. he has a mail slot in the door for that specific purpose. my husband took my cousin to pay the rent but he claims the money isn't there. now they have to be out by monday. can he evict them when there is a disputed amount? Yes, but eviction takes a long time. There is no way he went through a legal eviction process and you have to be out by Monday. It takes MONTHS to evict someone. This is just a few days? Your cousin should call the county housing department, a lawyer or legal aid. There's due process involved in eviction, but you have to know your rights. If you indeed paid in cash...SOMEONE MUST HAVE GIVEN YOU A RECEIPT...hopefully, you saved it...even though it was put under the door...OTHERWISE...someone just stole it...sorry....Yes, he can be evicted for failure to pay rent...sooo sorry about that...from now on make sure you PAY IN PERSON...to prevent someone from stealing the money... Well.. There is a need of proof that the money was paid cash.. it could easily be words from yuor husband and cousin against the landlors.. Was there a receipt or something? I think this case is loss since there is really no proof... I don't think the landlord will evict them but he will want his money.. If not, then it will be considered as a breach of contract.. Where is your receipt? If you can't come up with it - get a witness. If both are not available - you didn't pay the landlord. This is pretty much a "he said, she said" situation. Since there was no receipt of transaction, it never really happened. You can gather the rest of the story yourself. The eviction must take place unless there is another agreement struck really soon.
