My roomate has failed to pay her half of the rent. Is there anything I can do to keep me from being penalized |
Yes, we both signed the lease. I know that I am probably doomed because of that, but I was just hoping maybe someone knew of some way around that. We both pay our half of the rent with separate checks each month, so they have proof that I have been paying my half. We both have moved out and are finishing paying the remainder of the lease. Since I don't live with her anymore, I never see or talk to her. Neither the apartment's office or I can get a hold of her. The leasing agent said that she was sending the debt to collection and it would damage both of our credit. This just doesn't seem fair. Shouldn't there be something I can do? Why should I have to pick up her slack? The apartment will try to collect the unpaid rent from anyone on the lease it can reach or get the money from. It doesn't matter that you have paid all your portion of the rent on time, if they can't get the money from your former roommate, they will try to get it from you. As you already know, it isn't fair, but it is legal. Since you both signed the lease you are both liable. You should file a small claims action if you can find her. If you don't want you credit hurt, you will have to pay. This happened to me many years ago. We haven't spoken since then. small claims court maybe if she was threatened with legal action she might give in hopefully Although I understand where you're coming from, your leasing agent is right. My suggestion is to pay your roommate's half, then weigh what the penalties are for breaking your lease and moving into another unit. Maybe your leasing office will work with you if you agree to move into a one bedroom in the same complex. You should pay and then go after your ex roommate in small claims court. there is a way out.. look up the company that owns your complex.. go to there HQ and speak with a rep.. tell them your situation and ask for your lease to be transferred to a different property.. something more in your budget.. let them know people can come in and look at it your last month there so they can push it off so someone can take over your place when you move into the other place.. otherwise if they are a 1 property place which is uncommon.. you take that risk when you let them sign with you.. find a different roomate possibly? anyways good luck i hope i helped you a little bit with your options |
