Can the person I'm subletting from take me to court for not paying him rent?


I'm staying in student housing and I'm subletting from someone for 2 1/2 months. My lease says that I only pay rent for the last month and 1/2 that I am there...because the Old resident is responsible for the 1st month. However the old resident wants me to pay him for the 1st month. I said that I will be able to, but not all at once(even though the leasing office said I didn't have to)...now he wants to take me to court.

I don't have a contract with him but I figured since I was staying there I would go ahead and pay even though the office said I didn't have to. But I said I didn't have the money at once and he got upset and had his parents call me and threaten me.......

If your lease says you aren't responsible for the first month, you really don't have anything to worry about, tell him you aren't paying it and let him take you to court.

By the time a case is actually heard, the sublet term will probably be over anyway.

Unless you have a written contract with the person from whom you're subletting, the lease includes all terms to which you have to adhere.

He can take you to court if he wants. He'll lose. Bring the lease and an affadavit from the leasing office.

In small claims court, you do not usully need a lawyer. He can sue you for anything of small value in small claims court, he just has to pay the fees.

It is a fact that u r residing there for more than two and 1/2 month. As per contract you are obliged to pay one month rent. But what about the 1 and 1/2 month? was there any agreement that you could stay for any period but you shall pay only one month rent? Was he sharing the room or you were exclusively in possession of the room ? These are the arguments which you have to meet out.

If there is ANY proof that you lived/stayed there, yes. The judge will most likely award him a portion for any time he can resonably prove or attest to.

Ran into some accom trouble myself previously. Depending on your location, call the local tenancy helpline and get your rights clarified . A tenancy lawyer helped me resolve my issues in a small claims tribunal without any payment, freed me from a greedy landlord. Good luck.
