Is there any you can do when you are given a 30 day notice to leave your apartment unit? I always pay rent!?


And when I called the porperty management office they indicated that it's a "Business Reason"...So if some can please tell me if there is anything I can do. I have no where to go or that money to move out! I have a 3 yr old boy and a 10 month old baby....Please help me!!!!!!!!! I have till the 15th of next month to leave or else they are going to evicted us..

A lot depends on where you live. Rights vary greatly from place to place.

Do you have a lease?

Does your state allow evictions without cause? Cause is defined by the law. So are notice requirements.

Just because you got a notice doesn't mean that they will be able to get you out.

People can't give you any useful answers unless you provide critical details.

Unless you have a lease, you're living on what they call a month to month basis. Thirty days notice is legal in most states. If you wanted to leave, you would be required to give 30 days notice also.

Do you have a lease? If so, unless it says that they can evict you without cause ("business reasons" is without cause, from a legal standpoint), they cannot.

If you have no lease (or are in a month-to-month arrangement), they can ask you to go, at any point. However, they do need to provide sufficient notice. 30 days seems short, in my opinion.

You should check with a local lawyer that specializes in renter's rights. 20 minutes won't cost too much (you don't need a lawyer that charges $600/hour) and will give you the basics of what you need to know.

In most states this is very illegal. Go to the office and ask why. Ask for full names of everybody you speak to and go home and write this all down..... times, dates and whatever was said. Do not get into a he said she said conversation.... keep it all business. This will worry them to no end.

Next after doing this contact whatever housing authority that there is in your county. Odds are they will help you in some way.

If you are not in a lease, the manager can ask you to be out in 30 days, unless they are discriminating against you for some reason.

Provided that you are on a month to month lease, the 30 day notice is legal. Just as you would be obligated to provide the same.

Fortunately, you have good solid rental history with the management company. Finding another place should not be a problem -- especially if you have good credit.
