I want to practice Law & have my own Firm without a degree or being a member of the Bar? |
I have a few thousand and I am thinking about starting my own law firm. I called the local bar and they said it was a crazy idea to do it and that they would not allow me to join the bar without a degree. http://www.lawyerdude.8k.com/3789.html In all US states, and most countries, only a licensed attorney can practice law. If you ever need a lawyer, would you hire one without an official lisence? In order to practice law you must first pass the State Bar Exam. Without it you will not be able to go before a judge period. the thing is basically you would be what I would call a barrack room lawyer...........and that's worse than having NO legal training at all, is someone that thinks they can give out advice / counsel others............. I consider myself a lawyer every time I stick my middle finger out the window because some jackhole just did something stupid in traffic. So yeah, I'll take that to court. But I don't think I own a tie. Yeah sure, and why not open a medical practice while you're at it too. Give it up! Not Happening!!! Practicing law requires a license in every state. 49 states require a degree in order to take the bar exam. West Virginia allows anyone to challenge the exam. You can call yourself anything you like, but if you take money for legal advice and do not have a license, the first step will be an injunction, then a contempt citation and then jail. These are supposed to be consumer protection laws. if you had completed law school you would know that the first amendment is not absolute, despite its wording. Furthermore, your presumption that a judge can (or would) allow a non-licensed person to appear on behalf of someone else in a court is false. A court might (or might not) allow someone who is representing himself to consult with whomever that person wishes, so long as it doesn't disrupt the proceedings, but that is not the same as representing someone, taking resposibility for the case. Because you will not be able to get malpractice insurance, I hope you advise your clients that if you screw it up, you do not have any insurance. The first thing ANY lawyer needs to understand, is that the training is for them to understand WHAT the law is. |
