Tenants rights, what are they? Help me in my situation please!!?


If you know bout tenants rights and your way around the eviction proess and law please help me!

Heres my situation, My husband paid our rent $502 in cash stupidly. I walked with him as well as a fellow friend since we were walking him to his car. We dropped it in the drop box in an envelope with our addy. A few days later we get a 3 day notice to pay or quit. she told us we never paid our rent. When I went into her office calm cool and collective, and askd if she could double chek her files she yelled at me sayig I was accusing her of stealing. Make a long story short, she intially gave us until the 24th of oct to pay $502, we went to her manager and he gave us till the 29ths and this was agreed. We went to tell her we had the money and she would not take it stating she took us to eviction as of Monday the 22nd, sayiong we all agred to the 20th to have our rent paid . We never received another 3 day notice, i can't get ahold of the owner of the complex that said the 29th.

Can someone please tell me what to do because i don't have the 1st clue. Doesn't she have to accept payment anyways since we have not gotten the actual paper for eviction? And before she even starts that process, doesn't she have to give us another 3 day notice? BEFORE she gives us the eviction? We are on a 1 yr lease, only 4 months into it. I think theres been 1 complaint and it wasn't anything huge. She knows weve had problems with our past apt manager at a previous complex due to something entirely different and they are good friends. Can someone PLEASE help me, im in panic mode.

If you did not pay per the 3 day notice, the landlord can legally begin the eviction.

If none of the dates you mention were in writing, it is meaningless.

You will probably receive an eviction summons and complaint within the next few days.

Some state's require the landlord accept payment, other state's give the landlord the option to reject payment and some state's allow the landlord to accept payment and continue with the eviction process.

Land Lord and Tenant Law varies by jurisdiction (where you live) with us not having this information we can not answer your question, sorry. Almost every area does have a place where you can find the law for your area and get help. The first place to start will be your blue pages (government pages) in your phone book or the local bar association (Lawyer Club). These places can give or direct you to where you can get help.

Sorry about ur situ but I don't know anything about tennents rights but u have learned a hard lesson not to trust people with ur hard earned cash without the correct paperwork and receipts. Do u not have Trading Standards Office near u or in the telephone directory? they maybe able to advise u.
