Are automatic debit forms legally binding? |
I signed up a year ago to have my rent automatically debited from my checking account. The form I signed ensured accurate payment and no late fees on my rent. When I renewed my lease, my rent went up a little, but the office did not adjust the amount debited from my account. None of us caught the error for 4 months. Now they want me to dish out $120 immediately. I am willing to pay it off if three months, but they will not hear it. Any advice??? It is your responsibility to make any changes to ACH withdrawals, not the leasing office. They can't make any changes unless you complete a new form. However, most leasing offices would be willing to work with you since it was an honest mistake. I would speak to the manager of the leasing office. If she is not willing, call the company that manages the complex and explain the situation. Let them know how much you enjoy staying there (if you do). They usually want to keep good tenants. Sadly, it is your responsibility to assure you are being charged the appropriate amount. They will say that you should have been reviewing on a monthly basis and therefor would have noticed right away. Maybe if you talk to a manager or something they would try to work with you over the holiday season or something, but they aren't required to by any means. |
