Can rental leasing office report us to credit bureau? Long Story... if we break our lease but inform them....?


Alright here is the deal. We have been at this apartment for 2 years almost. It is here in Miami When we first moved in it was me & hubby & our almost 6 month old son. The leasing office said the rules were no more than 2 people per bedroom but since he was just a baby we could get the 1 bedroom, because of our credit score we had to put a double deposit of $1,580, fine we did. I found out I was pregnant and asked for 2 bedroom on first floor. We resigned lease because she said as soon as one became available she'd move us. Baby is now born and 3 months and still no 2 bedroom. We just got approved to buy a house. I don't care if we lose deposit but she says she will report us to credit bureau if we dont pay an extra $1,000 on top of that. Lease says we can terminate with 30 days written notice, last months rent & $200 plus another month's rent & forfit deposit ? We cant afford all that and mortgage. What should we do? Can she report to credit. Isn't it illegal to have 4 people in 1 br?

Rather than get evicted, you signed another lease because you were pregnant. You have already waited 3 months plus the 9 you were pregnant for a larger apartment. You are still in the small apartment you were told you could not stay in.

There obviously is not a vacancy problem if there have not been any in this amount of time. She shouldn't have a problem renting the unit you presently live in. DO NOT turn down the chance for a house.

In my state the only way a landlord can take you to court & report you to the credit bureau or anyone else is if you owe & don't pay rent. But you have been paying rent. How long are you expected to wait for this apartment? You have waited long enough. Time to go.

I would think the very worst that would happen is you would loose your security deposit. Which under the circumstances I don't see why you should give that up either if you can give a 30 day notice. This is worth talking to an attorney about.

You are getting taken advantage of in this situation.

Legally you need 40 square feet of bedroom space per person, so I don't think you have a space problem.

Yes, she can report you to the credit bureau that you broke a lease.

If it's illegal to have 4 people in a 1 bedroom, it's you who's breaking the law since you're there voluntarily, not her. It's not her responsibility to find you a place.

Your biggest mistake was agreeing to re-sign the lease instead of going month to month. So you might need to stay until the end of this lease, OR see if you can sub-let it and move out.

She can report it to the credit bureaus without a judgment because it is a written contract.

She can sue you and get a judgment for the amount she specified since it's in the contract.

She can put a lien on your new home after receiving a judgment.
