Can someone answer this not sure what catagory.to put this in.?


can i take the post office to court or sue them. i wrote some checks one to my landlord and my phone company was the other.i wrote the checks on 12-5-07. i checked with the bank and found out they have not been cashed yet. land lord and phone company said they did not get the checks. i wrote another check for my rent, now im disabilied and really can not afford the stop payment fee the bank charges for each check.can the landlord send me the orginial check that i wrote first can she send it back to me if she gets it in a week or so.they cannot cash the orginial check can they can i avoid the stop payment fee so the check wont be cashed again.if they are honest maybe she will send it back to me. anyway it was the post offices fault. i know its the holidays thats what they told me.

First, a check is only truely worth a few cents, so that would be what your claim is for... it stunks, but sometimes things do get damaged beyond reconision . Where did you send it from? your box? if so it is VERY possible that a theif took the letters out of you box. Other things that I've seen (as a carrier) is letters that get badly water damage (do to rain and snow) the the addresses get messed up...if that happened then it could take weeks for the letter to get opened and then returned. BUT most of all I see people putin gthe letter in backwards so the adresses doesn't show in the window.

If you send another checkand they cash the first one too then you can have recourse against then....

unless you stop payment on the original check, it can be legally cashed.if you trust your landlord and have told her not to cash the check you might be ok but she could if she wanted to

Unless you put a stop payment on the checks they can be legally cashed. I'm not sure if you can sue the post office or not. Mine once lost some mail of mine but when I complained they just said that once it leaves they're hands to go to another post office for delivery or such then it's not their fault.
Check with the Postal Administration.
