Dual residence state tax question?


If I live in New York (rent, family stays there, payroll under New York office), but work in California during most weekdays (staying in a corporate apartment), how does that affect my state income taxes?

If your primary domicile is New York, it's likely that you're liable there. But you should ask someone in your HR (payroll) department just to be sure.

Your last pay stub should give you the answer: the state taxes will be deducted for the state where you're liable to pay.

You will file a tax return as a California non resident, and pay taxes on the wages attributable to your work there. You will file a tax return as a New York residentm and pay taxes on all of your wages. You can claim a credit against your NY taxes for the California taxes you paid.

Generally, California would try to consider you a California resident, but you would be able to claim a closer connection to NY based on certain facts.....such as

1. Where your family and personal friends are
2. What address you use
3. What state your driver's license is in
4. Where you are registered to vote
5. Where your bank accounts are
etc.
