Three day notice to vacate? |
When I got home from work there was a piece of paper from my rental property that says three day notice to vacate. "This notice is to advise you that as a result of your delinquency in the payment of your rent including your utilities under the lease described above the undersigned terminated your lease effective immediately and demands you leave the premises on or before Nov. 13th Then is says NOTICE: you are being asked to leave, if you do not an eviction action may be initiated against you. If you are in doubt about your rights get legal assistance. Then it says if I have any questions call the ELECTRIC COMPANY?!?! btw... I don't know any legal terms so filing an action against me - no clue what you're talking about what this notice means is they want you to pay either the utilitily bill and any rent that you owe...they want you to pay within three days...if you pay the bill, then it will be canceled..if you do not pay they will have a lawyer file eviction papers with the court, a court date will be set and you will recieve these court papers...go to court and the judge will decide to evict you or not.. most likely you will be evicted and it will go against your credit... no, but they may file "legal action" against you If it says in your lease that your electric bill must be paid to avoid eviction then you may face eviction. You should contact the power company and see if you can make payment arrangements to avoid further action. No, you don't have to leave. No one can kick you out of a home you have inhabited and have a lease on with only 3 days notice. They have to give you 30 days notice in a formal eviction proceeding. They even admit it in the notice they posted--they indicate that you are just being ASKED to leave and that if they don't they MAY start an eviction action. Which means they may not. Maybe if your electric bill is included in your rent (as in a "bills paid" lease) and you are late; maybe not if you bring the account current and make the payment. Depends on the Lease Agreement and your State's Law. Talk to an Attorney who specializes in Landlord/Tenant Law. |
