How Can I avoid this eviction?


Help please! My husband was out of work for a bit and we got way behind. We bounced a check for last month. This has since been taken care of.We are now 2 weeks late on rent and received a 14 day notice to quit.Im scared to death of eviction.I need to talk to the office, but Im afraid of being judged and criticised. The office manager does not seem to be a reasonable guy.By next week we can pay the remaining balance, and we are working extra hours and doing everything we can to pay June rent on time as possible.We have other bills piling up that need to be paid too.With my dhs new job I thought there was a light at the end of the tunnel.Now I fear homelessness. Please help! Is there a way to avoid court?My hands are shaking as I type this.We both work very hard and can pay these bills now that my husband is working, and he'll be eligible for a raise soon.But if we get evicted, noone will want to rent to us and we have a small child. Thank you!

Being evicted is bad, but not the end of the world. Can you room with his/your mom temporarily till you get straightened out? It sounds like you are renting from a butthole company you would be better off without anyway. There is no law that says you have to have an apartment. Plenty of grannies rent out aunt jen's house after she died, and similar situations.
Court sucks, but is not the end of the world either.

Use your imagination...there is a solution to every problem. One thing that is NOT a solution is a payday/title loan. That will put you into the depths of hell. Go talk to the office. It's not a personal thing for them, it's their (sucky) job. Surely they can make some arrangement. Once you get it straightened out, start a budget and live by it, and tuck some bucks away for the next emergency.

Talk to your landlord, eviction is lengthy and expensive, pay what you can now, and give him an exact date you will have the rest of the money, and be sure to pay June on time, and everything should be fine.

There's nothing you can do but talk to the landlord. Even if he does judge you , witch I know he shouldn't , you have to let him know whats going on, maby you can get an extension. Avoiding the problem will only bring more drama, and you really don't need more drama. You have to think of your child. It wont hurt to talk to your landlord. You have to do what you have to do to try to save the roof over your head. Good Luck!

Do you rent on a month to month basis, or do you have a lease? If it's a month to month renting situation, the best thing I can say is talk to the guy - give him exact dates on when you will have money to give him, and then follow through and give him the money on time.
If this is the first time this has happened, he should listen - it's a whole lot easier for him to continue to let you live there than it is to find a new tennant. If you have a history of paying rent late, you might be out of luck. He might not want the hassle.
For future reference, make your housing payment the #1 priority. ALWAYS pay that bill first. Things like gas or electric can wait - those companies are actually more willing to work with you, to set up payment plans, etc.
Maybe finding a place with a smaller payment is a good idea - you say nobody will want to rent to you, but most landlords never check references. Find some guy who is renting places on the side, he'll be more likely to rent to you than a big apartment complex. You could also try cutting down on expenses - there are stores like Aldi, Dollar General, etc that sell groceries, toiletries, etc for dirt cheap. You could also try cutting down on driving - gas is too expensive these days anyway. The weather is nice now - ride bikes to work, or walk even. I have plenty of money & I walk to the store every week, it's only 2 miles away & is a great exercise.
There are plenty of things you can do to cut down on expenses. I'm guessing you've already tried adjusting your thermostat so it won't be running constantly. Turning it off completely and opening windows is a great way to save money too.
I can't say if you'll be able to keep your current place - only your landlord knows the answer to that, but there are lots of ways to keep this from happening again. Good luck!

Read your rental agreement, what does it say? It should be spelled out in there what can happen if you breach your contract, which you did when you didn't pay the rent.

Call the office, so what if they judge you, what do you care so long as they allow you to stay in the apartment.

When faced with mounting bills, prioritize them.....Housing is first! then in decreasing order of importance - electricity, etc. (You can get help with food from the food banks). Yes you may have to pay penalties, but you will have a place to live, and most penalties can be negotiated later.

As for June's rent, ask a family member for help, you need to get on top of the rent situation now.

You really should consider consulting an attorney about a Ch. 13 bankruptcy. This will delay the eviction proceedings and give you time to get settled in your jobs and back on your feet. It sounds as if you are in a rut that you need help getting out of. That is exactly what Ch. 13 was designed to do.
