I need advise on rights with a roommate in Florida ASAP!? |
I recently moved into a house in Florida 3 months ago with a roommate. When we first got the house they ran both of our credit, she did not have enough credit established so I went ahead and put the lease in my name only ( the leasing office does know that she is living here as well) The bad news is that you don't have a lease, so she does not have to give you notice. The good news is that you are entitled to your rent. I don't know about Florida, but in NY, any person that resides somewhere for thirty days is considered to have lived there and would be financially responsible for their rent. Therefore, get yourself a lawyer and sue her for the court costs and the remainder of the rent. Nope, there is nothing you can do.... she actually was not living there legally. You could take her to court. If she had been paying rent before then, it will be obvious to the judge that you had some sort of verbal agreement that she was to be paying rent, regardless of whether her name was on the lease. With no lease, she can leave whenever she wants though. thats a heaping portion of SOL being that she acknowledge she didnt leave 30 days notice or anything, i suggest taking her to small claims court andsuing her for her portion of the rent owed for september. or with hold her portion of the security for failing to do . find someone else and have them sign a side agreement agreeing to give 30 days notice if they plan to vacate. good luck!
