In Arizona, do Apt renters need to give a 30 day notice of leaving if the lease is up in 30 days?


I was charged an extra months rent because I did not give a notice saying I was leaving. The renting office never sent me a letter saying that I needed to give that notice. Is there a law or anything that protects renters rights regarding getting charged this amount? I should not have to pay because I moved out when my lease was expired.

You should re-read your original lease. Most leases state that unless renewed, they automatically convert to month to month rentals at the end of the lease period. They usually also state that either party (tenant or landlord) must give a 30 day notice in writing if they wish the tenancy to end.

If this is the case, yes you should have given a 30 day notice and you are liable for the rent until the end of that 30 day period or until the unit is re-rented (which ever comes first).

check the states tenant/landlord laws online, lots of states if you do not give notice, then your lease go to a month to month lease, in this case you should have been charged for the next months rent

First you need to check the lease that you signed that addresses the need for written notification to the landlord and the consequences for failure to perform under that clause, if your lease is silent to that, then you will need to check the landlord tenant laws for Arizona, here are some links that might help you find out

Yeah, about every lease on the planet renews if you don't terminate with notice. You're on the hook.

Put the shoe on the other foot, what if your landlord had started to move another tenant in when your lease expired? Sorry your lease is up, these guys are moving in TODAY so get out. You have to give/get notice.

Now if your landlord moved someone in prior to end of the month, they can only pro-rate for the time the apartment was empty.
