Legal advice please!!!!Wrongful termination of employment under no contract?


Orlando , FL. Me , my husband and my 1 year old daughter. Got a job offer from someone that was my friend. Here is the email they sent :
"Eventually, we will have to hire a pre-press/design person who will be in charge of all the marketing, and the website-all creative stuff. (Well, we really need that person now, lol) Plus, there is a house across the street from us for rent (3bdrm, 2bth) for $900/month.
Thought I'd check to see if you guys were interested at all? We could pay around $30,000/year"

"Dave wanted me to mention that we were originally looking at the house across the street for an office, and he wants to put forth the idea that we offer you less pay, but pay for all the rent and utilities at the house, have you live there, and have all the machines there. I know Ryan is happy where he is, but he would have a greater opportunity to be creative here, but I don't want to be pushy!"

When we got here they told us that they were then paying $1050 for the house. My fiance has been working 5 days a week for a month now they've been paying him $247. weekly and he has been working overtime. Now things arent working out. Because the company just has no organization and I've think they've realized they cant pay us. Since I was working too. They were paying me $100 a week for working 4 hours every day, when they had actually offered me $150. I think to this day they havent paid us what they offered. Took advantage of us by not offering a contract to sign.And since they were friends I never thought something like this wouldve happen.It goes deeper than that. But now they are trying to kick us out of the house when we have nothing else to fall back into. We left our old apartment to come to Orlando and Ryan left his job to work for them. They are giving us 3 day eviction notice and we have a baby and no savings since we havent gotten paid enough to be able to save any of the money.We have check receipts. There should be something that protect us in this case?
They are horrible people and they shouldnt get away with this.We think they might be doing some illegal business by printing copy/pasted barcodes into the books and magazines being published. I dont know how the law is with that either but I think there could be a case there. Please I need advice from someone that knows.What is the name of your state?

Sorry, but no contract means that you are an at will employee. They can fire you for any reason or no reason at all.

Besides, if the company is falling apart, why would you want to stay there?

I doubt that you can even sue , if you did have the money...

Well, first of all, sounds like their business is going belly-up, which means you wouldnt have any security, or be able to get money from them anyway. They cant evict you in 3 days. Ignore the eviction notice, as it will take several months to have a court rule on the eviction.In the meantime, immediately start looking for new jobs and a place to live.

I'm so sorry, but you are screwed. Even with a contract, any eventual judgment you could win against them would be worthless because they have no money to pay it with.

There are 3 exceptions to the employment at-will doctrine, and Florida is one of the states that does not recognize any of the exceptions. I wouldn't bother with the stuff about the business being illegal either. Even if it's true, it is not worth the time, effort and expense involved. Karma is a b****, and it will come back to haunt them.

My boss (lawyer) has done a lot of employment law in the past, although he refuses to do any more. The thing with "wrongful termination" is that it does not really exist in an at-will employment state - which is most states. If you are not a private contractor (self-employed), you can be fired for any reason at any time. The only kind of firing you are protected from is if you are fired (or otherwise discriminated against) on the basis of your race, sex, ethnicity, or religion. You are protected from that by Federal law, but that's it - that and the Americans with Disabilities Act protects you from discrimination due to being handicapped. In most cases a true "wrongful termination" would be if you were the only black employee and they fired you because of it, or the only female employee and they fired you because of it. Or if you got fired for refusing to boink the boss.

Not fair, I know, but true.
