Can I get out of my TX apt lease because the property manager can't seem to correct a financial mistake? |
One month they lost my rent check and didn't find it until the middle of the month. They later acknowledged they misplaced it, but I keep getting past due notices on my door. They can't seem to get the mistake cleared up in their computer system and their notices are driving me crazy! There's also stray cats living in the parking lot on the property and one of them just had kittens. I've reported it to the office serveral times but they do nothing to get the cats rescued or relocated by animal control. Also, when I get the notices about the past due charges, I call the office and leave a message, but no one ever returns my call. I'm just frustrated with the whole issue. Their mistake is causing me major undue stress. Help! I would call an attorney that does free consultations, talk to him/her and see if you have a case. It sounds to me like you do, but you want to be doubly sure, that way if they try to sue you for breaking the lease or for rent due, then you can go to court, counter-sue for sterss and also sue them for lawyer and court fees that way you don't have to pay out of pocket. Good luck Phone calls do nothing for you legally. You have to put this in writing and send the letter Certified Mail, Return Receipt Requested. Follow the directions carefully -- using your address for a return where indicated and their address for delivery where indicated. Did they achnowledge publically? I have found no matter where your at when you go to court (if you have to) paper rules, l recommend that you send your concerns to them in writing, certified mail return receipt. This will sustain your claim. I would ask them to Void the lease to avoid problems in getting out. I hope I can help. I have mged properties in TX FOR 22 YRS This sounds like total incompatence to me. U should go to the office not call, tell them u will wait there while they correct the rental issue, get the correction printed out and have the mger or her assistant sign it! If they will not do this call their mgmt company on the spot! Also seems they may not know how to fix ur rental error and r just doing automatic computer notices. I dont know what system there on if its rent roll they need to do a neg and then a pos. adjustment to ur account in the month and batch pg this was on, or r u getting rental past due, because their error took late fees out of ur rent pmt. leaving u a rental bal. if so they should be able to go in computer correct late fees deduct money not owed and make note in computer why there is a rental adjustment very easy, I am shocked this has not been attended to, as for the cats send this in writing mail it return receipt requested, again call their mgmt company u have the right to talk to their supervisor, none of this legally gets u out of a lease but I am hoping to solve ur problems, when ur lease is 30 days before renewal give notice and find a new place, this sounds so poorly managed I feel sorry for u, also now that I give it thought send a certified receipt reurned letter re: their rental error as well if they will not correct the problem while u wait in the office, believe me they should be able to fix this in the computer in a matter of 5 mins. tops. Also keep ur receipt if its money order or ck. it can be very important if this continues. And please relax u have no reason to be stressed u paid the rent they need to fix their mistake, its human to make mistakes and a ck. can be misplaced but it should be handled once they realize their error.
