Can i take my council to court?

i live in private rented accomodation and have been off work sick for a few months.in july housing benefit told me that i did not qualify for housing benefit.on the 19 august i was given notice to quit by my landlord who was advised by housing benefit to do this.a week before i was due to leave my property i phoned the housing benefit office in one last attempt to sort this out, which they then realised that they had not looked at my wage slips even though they had them on file and had worked my benefit out on the basis that i was earning a full wage instead of ssp.they now have agreed to pay back 拢1700 to the land lord which backdates to july, but now me my wife and 2 children are homeless all because of the rent arrears which was housing benefits fault and have admitted to

i also have evidence of them admitting to this are there any solicitors out there who would now if i have a good case

what makes me very sad is, the British get made homeless and all the immigrants are welcomed with open arms and given a house and money when they put their foot on British soil.

contact a newspaper, then sue the council.
contact the citizens advice bureau.

Get a very good lawyer and take them to court.

Get on to your local councillor quickly. The council should house you for making you homeless xx

Man that is tough !
I am currently working two jobs and suffer from chronic back pain because of a similar situation.
The council only covered half of our rent because i was self employed and now we will be homeless by christmas !

im in the same situation as well and they honestly take the mick, you try and provide them with the right info and they still can't work it out then you get demand letters and you have to do it all again, im sick to the back teeth of forms/letters and the stress of it all, yeah take them to court and make them suffer good luck

Instead of suing them you would be better off making a homeless application and insist they prioritise you due to your being homeless because of them

To sue them....you will be suing us at the end of the day if its money your after.

Go sit in the council housing office, they have to find you somewhere to live when you have kids under 16.
I thought a notice to quit wasn`t enough to evict you though, they have to take you to court to get you out and you have evidence to show the court that it wasn`t your fault.

Go for it.

They have a duty to house your family.
I think you have a good case and someone needs to make these councils aware that they are not God.

You know what, stories like this make me so, so mad. I was in a similar situation to you but because I was a council tenant the council had to go through the court before they could evict me. I had a solicitor and the back rent was paid by housing benefit so I did not lose my home but had to go through the agony of court appearances. As Lynn has said immigrants get preference to housing and benefits over people born and bred in the country. It's about time this country got a back bone. Get yourself a solicitor surely the council have a duty to re home you. Good luck

I sympathise with your situation & agree that the council should at the very least re-house you since they are the reason for your homelessness, unfortunately unless you have their 'admission' in writing taking them to court will only make things worse when they close ranks & deny ever saying it was their fault which could leave you with court costs aswell as the arrears if you lose.
