Rental agreement?


I have a question that I really hope you can answer my husband and I are seperated and he never worked and he now lives with his mother well he is on my lease as a lessee as I am but heres the catch my lease is up at the end of July and I still live in this apartment and want to continue to stay in this apartment can they still rent me my apartment but just with my name on it the reason I am asking is because I have been getting threats from my exstranged husband that he will come into my apartment and clean me out with all the furniture while i am at work for a matter of fact yesterday I got home from work and he had been in my apartment the manager there said he went to the office to get a key to get in and he came in. I told him to quit coming over there because he has already taken all his belongings. I really need to know what I can do to keep him from getting in my apartment.
According to the manager he has to come in and sign his name off the lease.

You will likely need to resign a separate lease with your apartment complex. If he is harrassing you (which it sounds like he is), then try to get a record of the harrassment. Texas is a one-party state when it comes to recording conversations, so you can record any conversation where he says that he will come and take your furniture, etc., then take it to a judge to get a court order to get a restraining order, and his name removed from your lease.

Unfortunately your husband has every right to enter into your apartment. Your best bet would be to move into your own place immediately with only your name on the lease. You would end up paying double rent, but isn't that cheaper than buying new furniture and belongings? Until your husband's name is off of that lease, he has just as much right to be in the apartment as you do.

Also, beware, since both of your names are on your lease now, you are both entitled to pay rent. However, if he doesn't pay any rent, it all falls on you.

I'll say it again, I think your best bet is to sign a new lease and move out of your current place ASAP.

Also, read up the lease that you signed for more details, many places have different rules.

Yes...tell the leasing office that you want to take him off the lease when you renew and that you do not want him to be allowed access to your apt. Also, file for & get a divorce & restraining order...these should protect you if he claims to have any rights to anything due to being your husband still.

File a Restraining Order then present a copy to the rental office and ask for a new rental agreement.

If they do not cooperate then you must move.

In addition, for your own safety while you are there, if you don't already have a chain lock on your door then install one. You can do this yourself (a slide lock is more difficult to line up) so there is no need to call the apartment complex or even let them know because they may say no. They may charge you a fee to remove and repair after you leave but it can't be much (they cannot charge for a new door or casing).

being that your lease expires, let your management know you will be renewing the lease alone! that can be done without his consent. you can renew your lease without him being that he doesnt pay rent, once u sign and renew for the full year request that yopur locks be changed being that now you are the sole leasee and being that a roommate has moved out they are obligated to change the locks as well. alert the building manager of your situation so next time he comes in to get a key he will be denied once u resign the new lease.
