What do I do about harrasing neighbors in an apartment?


I rent an apartment in Eagan and when my fiance and I moved in a girl that lives below us complained that they could hear everything that goes on in our apt, so we did our best to be quiet, a couple weeks later she tells my fiance that her bf wants to fight him, and now in the last couple weeks theyve been calling the cops on us nonstop for noise complaints when we aren't making noise. Twice the cops came and my fiance was napping with no music on, and once while we were making dinner with no music on. The last time they came I was on the phone with my fiance after I got off work and he was home with music on, but I could tell it wasn't very loud, he got a court order in the mail saying he has to go to court because it was a repeat offense, the funny thing was that the time on the order was almost 2 hours earlier than the cop actually came! I dont know whats going on but the harrasment has been happening for 2 1/2 months now & the office wont do anything about it, what are our options?

I had the same problem. My downstairs neighbour complained constantly about my cat (my cat!) walking around... she had my landlord come and check to make sure I didn't have a large dog in the apt. I became a nervous wreck trying to tiptoe around doing my normal activities and trying to keep my cat from running around too much. The apartment mgr. knew that it wasn't my fault but there was nothing more she could do about this complaining tenant. Eventually, I just moved out.

I am sure your normal activities seem loud to them in the apartment below, because many apartments are not solidly-made enough to muffle noise. That is why I never would live in a ground-floor apt. if noise bothered me (which it doesn't). You should ask your landlord if you can move into another unit, preferably on the ground floor. They may accommodate you because they are probably tired of these other people's complaint. Of course, the one drawback is - if you move into a ground floor apartment, the tenants above may seem noisy to you. But - you seem sane and probably wouldn't treat anyone above you the way your downstairs neighbours are treating you. They sound crazy and there is absolutely no dealing with them - get out before the situation escalates... Good luck!

talk with your landlord and see he can work it out with you and the girl below you.

then, work out a way for you to be in her apartment during a time and have your boyfriend up in your apartment, doing "normal" stuff , like walking , playing music etc.

Then see how loud it really is.

If you dont hear anything, then file charges with the police for false complaints (illegal) and on that "court" appearance, file a motion to counter sue.

if you do hear something, then, its the building that need to be fixed by your landlord. because "normal" acitivies should not be heard no matter what.

Chances are if they are taking you to court and every time the cops showed up and you werent doing anything wrong as far as they could see then it will be thrown out of court and if they call the cops again after that the cops will tell them to cease the 911s cus they have real crimes to take care of sounds like the court will be on your sidde too

I think that the other answerer has a great idea! But I would make sure that my landlord and possibly another witness be with you.

What about the people next door to you? Can you ask if they hear you?

Can you find out from the police if she complained about the people before you? Maybe she's just a nut.

Possibly speak to your landlord about the neighbor - if not, then get an attorney. Make the neighbors prove it all.
