Room mates won't let me out -- now what? |
I recently decided that I wanted to move out of my apartment for several reasons. One of the main reasons is that one of my room mates moved her boyfriend in. Her boyfriend is addicted to drugs, doesn't have a job and doesn't pay rent. He has also talked about wanting to grow drugs in our apartment, etc. I don't feel safe around him or his friends and I just want out b/c our place is disgusting. I told my other room mates I wanted out and that they needed to sign the papers allowing me to leave, and then have her boyfriend either sign a new lease or pay them every month. They both said they wouldn't sign for me to leave. This same room mate also bought a dog and isn't paying the required fee to have it. I'm wondering if it is a good idea to tell the leasing office about all these problems and see if they can do something about it. I'm just not sure the best course of action to take. I've tried to find someone to replace me, but no luck yet. Any suggestions? you could consider telling your roommates to sign or you will have to leave without the papers and settle it in small claims court later. Its a little bit of a game of chicken, since they probably know you don't want a bad reference from the current landlord, but it sounds like they might have more to lose, namely the apartment, than you do. you might as well tell the people from whom you are leasing the apartment. they will find out sooner or later. it would be better if you left on your own terms. before you do that set up a few private security cameras where they cant see them. then you will have evidence of the illegal activity. Talk to the leasing office and if necessary talk to a lawyer. You should have the right to leave if you're in an apartment where you no longer feel safe. Talk to your landlord. Give him your reasons for wanting to leave (you don't need to mention the dog). Tell te leasing agents, they might help, also if you go to the police, they migh help too. I know that for safety reasons you can get out of a lease....good luck You have several legal options but, if you want to leave you can. They have already breech the contract that you all agreed upon so, if you want you are in your legal right to give them notice that you are moving an they can not hold you liable to the lease. But you must give them a written notice before moving out. The real question is do you have a plaace to go and can you afford it . You need to get out of there, find somewhere else to live. Then get the police to escort you to get your things, file a report with police and provide the leasing office with a copy. So if the leasing copy tries to sue you. Dont tell anyone just do it. I feel really bad for you, but dont stay, if the police come in they will arrest everybody in the apartment even you. This could be bad if you dont get out you could get hurt so be careful. Sounds like your roommates need the heave ho... i would sit down w/ ur roommates. state ur reasons for wanting to leave. if they say that they wont sign the paper for u, inform them that u have no intention of staying there and if they wont sign then u will have no other recourse but to take it to the landlord. im pretty sure that they will sign after u tell them that as they take the chance of being evicted or worse yet having the landlord call the police over the drugs. but if they still wont, then do just what u said u would and go to landlord because they obviously dont care about the repercussions. that is what i would do anyway. |
