Renter's right?


I signed a lease on Jun 30th. During our initial conversation, landlord failed to tell me that she required a secured form of payment for rent and deposit. Due to the long holiday weekend, we agreed that I would meet her on July 5th with secured payment, and she would hold on to the checks that I had given her. On the scheduled day to meet with her, I had an emergency come up at work. I promptly called her, she was not avail. Left msg with her husband. I also called back later that evening and left her a detailed message that I was able to go to the bank and got secure funds for her, but I would not be able to meet her to give funds until Friday 7/7. I was out of the office on Thurs and Fri...I called her Thursday evening to let her know I would not return until late on Friday..but I put the moneyorder in the mail. When i returned on Friday at 5Pm.. she had left a note stating that due to breach of lease she wanted me out by Sunday 7/9.

She can't just leave you a note. She must have an official eviction notice for it to stand.

If you can't reach her by phone, try going to her house and explaining the situation. It seems as though she's willing to jump the gun. If you're having problems NOW, you'll more than likely have problems later down the road.

If you can find another place, by all means, take it, and forget about the entire situation.

Since you've already sent the money order, she has no right to ask you to leave, without the proper eviction notice. Did you keep a copy of the Money Order ? If so, show it to her when you go see her.

Edited to add:

She also must give you adequate time to move. Two days is not adequate time. An official eviction notice gives you 30 days and if you still have not found an acceptable home in that time, gives you an additional 15 days.

You may want to call the State Real Estate Association for your state to make sure the laws are the same for you.
