How can I get out of paying the penalty for breaking my lease when it's due to loud neighbors?


I have complained many times about my neighbors and even asked the leasing agent about their noise policy before renewing my lease last year. They told me that it's expected to be reasonable "apartment living" noise levels, but the nieghbors have not complied and I don't know what the office has done (they said they will talk to them, but I'm not certain they have). They have a piano and other musical instruments, scream at each other and make loud, constant banging noises that shake my apatment. The last time I approached the neighbors, they yelled at me and security didn't come when I called. I want to move out, but don't think I should have to pay the lease breakage fee (2 months rent). What can I do?

Just look around until that lease is up. Sorry , but thats how it works.

Prove that the landlord breached the contract in some way. Go over your lease carefully and determine how the neighbors actions constituted a problem your landlord could have solved.

You can take it to court. I believe you have a right to sue since you have complained many times. As a tenant or ex one you have/had certain rights, research them thourougly and then proceed with action.

YOu either pay thhe fee or stay. Unless they are making noise after 10 or so there is nothing you can do to force them to live by the standards you are setting.

If this occurs late at night you can call the police, as they are "disturbing the peace".
