Can my friend, who owns a rental property in Los Angeles, evict a tenant who is messy?


The tenant has lived in a rent-controlled building for the past five years and is payng significantly less than the new tenants. The tenant also has two cats and lives alone. We went into her place after having given her 24-hours notice to repair her toilet. When we got there, we saw office file boxes overflowing with her belongings, her dirty clothes were overflowing out of the hamper, and her bed was unmade with the mattress showing. There was no feces or urine anywhere, and there did not appear to be any pests. She's a packrat but you can still easily walk into her apartment with no problems.

Can my friend evict her? Does anyone know of a landlord who has successfully evicted someone for being messy in Los Angeles?

This is the problem with owning or buying investment property in rent controlled areas.

I wont do it because I wont have someone else telling me what I can charge for providing housing without regard to market conditions.

You cannot boot someone for having a different standard of living than you unless they are breaking laws or causing a health hazard and even then you would have to give them time to correct.

A judge would see right through that one. Rent Controlled means investment controlled/income controlled. When a government entity (city or otherwise) has control over your investment you really have to decide if that is a good investment.

You can give notice to move a property manager into that unit or move in yourself or family members. But may cost you relocation fees..... Some info below might help ya.

Do what you gotta do RIGHT or dont do it at all.

A landlord can use a written three-day notice
(eviction notice) if the tenant has done any of
the following:252
鈥?Failed to pay the rent.
鈥?Violated any provision of the lease or rental
agreement.
鈥?Materially damaged the rental property
(鈥渃ommitted waste鈥?.
鈥?Substantially interfered with other tenants
(鈥渃ommitted a nuisance鈥?.
鈥?Used the rental property for an unlawful
purpose, such as selling illegal drugs.

There is the 3 day for trash and waste too but it doesn't sound like the lady is like that. If she is messy, she is messy. You should see some of the college guys that I rent to. It sounds like your friend just wants more for the rent and a judge would probably agree. If she pays her rent on time she should be happy. I am not sure about rent control but if there is no lease than she can evict anyone with a 30 day notice. If there is a lease than she should wait until the lease expires. I can understand your friend wanting more if she can get it why not but maybe she should just buy another building instead of worrying about one apartment.
