Can my friend, who owns a rental property in Los Angeles, evict a tenant who is messy? |
The tenant has lived in a rent-controlled building for the past five years and is payng significantly less than the new tenants. The tenant also has two cats and lives alone. We went into her place after having given her 24-hours notice to repair her toilet. When we got there, we saw office file boxes overflowing with her belongings, her dirty clothes were overflowing out of the hamper, and her bed was unmade with the mattress showing. There was no feces or urine anywhere, and there did not appear to be any pests. She's a packrat but you can still easily walk into her apartment with no problems. This is the problem with owning or buying investment property in rent controlled areas. A landlord can use a written three-day notice There is the 3 day for trash and waste too but it doesn't sound like the lady is like that. If she is messy, she is messy. You should see some of the college guys that I rent to. It sounds like your friend just wants more for the rent and a judge would probably agree. If she pays her rent on time she should be happy. I am not sure about rent control but if there is no lease than she can evict anyone with a 30 day notice. If there is a lease than she should wait until the lease expires. I can understand your friend wanting more if she can get it why not but maybe she should just buy another building instead of worrying about one apartment. |
