In Colorado can I break my lease if my children are being harassed and assaulted by other tenants?


My children all ages 10 and under are consistantely being bullied, cursed at and on 2 occations phyisically handled. The office has many letters from me regarding these problems.

Your breaking of a lease is a separate issue from the harassment of your children.

If they are being bullied, etc check on the possibility of hauling their parents into court. It usually doesn't require a lawyer, just go to the officers in your local Juvenile department and see what they can do. Why should you and your children have to move because of them??

As to the lease, that is a contract. If the "office" is aware of your predicament and are willing to vacate your lease, you can move in peace. Just be sure to get it in writing.

If they are not agreeable, you will still be bound by the contract. You may be able to talk to some tenants rights organization or legal aid to find out what remedies are available in your area.

NOTE: As a mom, I know what you are going thru. I have learned that moving will cure nothing. You need to take this bull by the horns and make these parents responsible for the behavior of their children.

If you called the police each time and filed a report, I would say you could definitely get out of the lease. But if its not on record, then its just your word against whoever's. The office that you want to break the lease with will probably "lose" the letters with your complaints. And if they had done it to my kids, I would have called the police and had those jerks arrested for touching a hair on my babies' heads. I hope you took legal action when all this happened. If you never contacted the police, you might be SOL.

First contact the police and tell them of the harassment, Also contact your landlord and tell them of the problem, then contact your county court house to proceed. In most cases you can break a lease under statutes, if the conditions are unsafe and nothing is being done to protect you or your family.
