Can my condominium management office withhold my package delivered by DHL Express?


Facts: DHL Express delivered my package (without my permission) to my condominium management/leasing office. I am a tenant under a lease in its second year. To which, I just learned from the condominium management office that if the landlord does not file your lease with them and you do not present proper identification, they will not release your package. I have yet to go to the condo declarations to see if this is codified in the land records, but the condo manager is stating that it is. Does Virginia Code even allow them to hold your personal property hostage like this?! It seems that Virginia would be smarter than to allow condominium declarations to override personal property/chattel law. I'm in Arlington County, Virginia, and I'm very frustrated that this is all happening. Any thoughts?

They cannot. If they are holding your property and refusing to give it to you, it is theft. Plain and simple.

Go to the office and ask again. If they still refuse to give it back, go to the police, and file a report.

If the police don't do anything, sue them in small claims. Sue them for the value of the package, plus $1000 punitive damages.

BTW, my answer is based on the presumption that you indeed showed some identification. I think it's reasonable for them to verify who they are giving the package to.

I would simply call DHL and insist they deliver my package to me. Let them worry about all that stupidity. You may even have recourse by filing charges against those holding it for theft or attempted theft.

Condo laws cannot supercede laws of jurisdictions in which they reside.

You could inform your co-residents of this behavior and get together with them to create a stink. Loud wheels usually get greased.

Get a copy of the lease and your id and give it to the management office for their files. They should give you your package then.
