Can an apartment agency hold u to your lease if u have reported that u fear for your safety?


I have had numerous problems with my downstairs neighbor and have come to fear for mine and my family's safety. I went to our apartments office and requested to switch apartments and they wanted me to pay money to do that. I didn't have the money so I found another place to live. I gave my apartments notice on April 1st and they told me that they will be holding me to my lease until october. Can they do this? Even though I am moving because they failed to do anything to help us?

Where can I go to see what they are resonsible in doing for my safety? I want to be able to tell them....."if you would read law......you failed to provide me a safe enviornment so I will take you to court", i really dont want to go to court because i don't have the money for it!! Help please!!

That is a problem that is tough to answer, They must address your safety problem, and it seems that they would not do that without payment. When they made the offer to take more money, they admitted that there was a concern. The fact that they offered you another place puts the fault at their office door. They have in essence constructively evicted you.

Once again, safety issues are their responsibility.

they wanted you to pay.

YOU did not say what actions that
neighbors were causing that forced you to fear for your life; did everyone
else vacate the apts?

Maybe you jumped the gun
[excuse the term.]

YOU do have one other option;
find a tenant for your old unit--
and you become the unit's
landlord--not the current landlord
for the entire complex; that
is called a "sandwich" lease cause
the new tenant is sandwiched between you and the natural landlord.

Not all states require the landlord to re-rent the property...so yes, you may be liable for rent until October.
