What do i do if my leasing office is trying to charge me for the month i am not staying there?


the leasing office gave the option of doing a 2 month buy out to break my lease. now i am being told that i have to give 30 day notice and the are going to charge me for may even though i will be moving out on or before may 1. i'm moving because of drug activity going on around my building and with my job, i cannot live in a location like this

If you fail to give proper notice, the leasing office is right...you would be responsible for the full month of May. All of this should be spelled out in your lease. You did read the lease right?

State law determines when the renter has to give notice for vacating and what is owed if notice is not given in time.

In New York state, for example, you'd have to give notice *before* the last month you plan to be there. So if you are leaving at the end of April, you have to give notice on or before March 31--and mailing something that day isn't good enough.

Whether the leasing office can do what it's doing to you depends on the laws in your state.

You are breaking your lease, so you are at their mercy. The drug activity is not the leasing office's fault and is not a legal reason to get out of your lease.

Since it is already April, your 30 day notice would probably not go into effect until May 1st. Most states require the 30 days include a full rental period. You would owe for May.

They can sue you for the rent or deduct it from your deposit if there are no damages.
