How to make property management solve the smell leaking problem?


We've lived in the current rented apartment for 2 years. In this building, most of the tenants are from India. When they cook, the terrible smell comes from the heating system to our bedroom and bathroom and stick there for 2-3 hours. The smell makes us vomit and our newborn baby crys a lot. We report to the leasing office about this problem and they said you can not ask people not to cook, but there may be something wrong with the circulating system causing the smell leaking. Definitely something is wrong in the vent/heating system, because we never smell that before and recently it gets worse. Today the maintainece guy comes in and with a very bad attitude saying the smell is from outside and goes into the circulating system, there is nothing wrong. He didn't even check it !
I believe the landlord has responsiblities to solve this problem. because this problem didn't happen before and in other building. How to file a complain? the smell make us feel sick and couldn't sleep.

There are two things you can do, but neither will "guarantee" you a resolution.
One: You can send your landlord a NICE letter (venom gets you nowhere here, but may help you later)- asking him to please check into the problem, or else you will take him to small claims court. If the problem isn't fixed, file- this is where your "nice" letter will help you- it will show that you are being respectful-
Two: Once again, send your landlord a NICE letter telling him he has 2 weeks to get the problem fixed, or you will be fixing the problem yourself and taking it out of your future rent. If he doesn't do anything, call a repairman yourself. Send him a copy of the invoice attached to your reduced rental payment.

1.) be sure that the letter is sent return receipt so that you KNOW and can PROVE the landlord received it.
2.) There is no guarantee that the problem can be fixed- depending on the laws and building codes in your area, there may be nothing that can be done. If the ventilation is working, and is up to building codes, all of the above may be for nothing.

Which country are you in? You can go talk to "citizens advice bureau" in every major town, in England and they will give you the legal advice. You could also get some frozen prawns and hide them in or close to the maintanance guys office. They will smell worse than anything you are smelling after a couple of days and he will never find them. That is called "lighting a fire under someone" and I bet he will get all the smells fixed after that
