Texas State Law?


A person becomes sick and must leave an apartment (and the lease) to live with someone who can take care of them. The apartment managers demand that the person show up in the office to discuss the lease and payment arrangements even though the person is sick and has transportation conflicts. Is that legal? Can the person get a copy of their lease without having to go to the trouble of going back to the apartments sick?

No. It's not terminal. If that were the case, who would be worried about their lease? It's just an illness. Temporary and contageous... Lol. WTF

I would send the landlord a certified letter stating you have vacated your apartment due to an unforeseen serious medical problem. By having the letter the landlord can go ahead and rent the apartment again without going through a formal eviction process through the court. Evictions through a court of law are a matter of public record and can come back to haunt you when/if you want to rent or lease again. If the landlord doesn't have to pay for legal fees and can rent the unit more quickly, it may reduce the amount (if any) you would be liable to pay.

In your letter you could ask that a copy of the lease be sent to you so that you may resolve the issue in good faith.

I'm not a lawyer, this is just what I would do. Is there a local non-profit legal service that might be able to give you some free advice? Maybe you could find out if such a service exists through a social service agency. Good Luck!

What kind of sickness are we talking about? Is it terminal? It really depends. Without more information, I wouldn't speculate.

fax them a copy of your diagnosis from your doctor, in the lease there is always clauses as to how to buy out of your lease--if that is what you want to do,there are no clauses as how to make payment arrangements if you can麓t pay rent for whatever reason, they will play hard ball because they want their money. They usually want their way or the highway. To answer your question--- they can not make you do something you can麓t. Thank God for AMERICA. You can get a copy of your lease, they might have to verify who you are, but they should not take a harsh stand in your condition--especially if this can be verified. Always document time,date, and with whom you had these conversations, if you can record them the better. you might need proof you are not the s.o.b., they are .Sorry you are going through this in your condition.Good Luck
