We moved in some apartments in November 2007. We gave them a check list of things that needed repairs......?


My understanding is that they have 30 days to repair or talk to us about everything on the repair list. It took them 3 months to repair some of the stuff on the list. I had to call them and ask when it was getting repair... the office manager told us that we was overlooked. Also.. Our neighbor above us was really loud at times...like around 2 or 3 AM and was waking us up.. I called to complain and i was told by the office manager that i needed to go upstairs and ask her to be more quiet...

Is there any laws that can get us out of our lease without having to pay the fee for breaking the lease???? I thought there was but I can not find anything online....

READ your lease carefully. Put your complaints to your landlord in a letter. List the items which were first listed when you moved in and then list the ones which still need attention. Ask to have them done by the end of the month. Tell them that you have (you have, haven't you?) asked the upstairs tenants to be quiet on several occasions, but the loud early morning noise continues and disrupts your sleep.

There is no law that landlord HAS to fix anything on your list, but a good landlord would want to fix most items. The main reason for such a list is so that YOU will not be charged for any of these repairs upon leaving the apartment, since they were there when you moved in. There is no timeframe for them fixing any items, unless they agreed to do so in writing. However, a reasonable time period has passed, and the items have not been fixed.

You could try talking to the manager and telling them that you are unhappy due to the noise and failure to have repairs done and ask if there is any way you can agree to terminate your lease early, without penalties.

Try googling Landlord and tenant in your city or county. Usually, there are offices that assist people like you for free. Good luck. Did you keep a Xerox copy of your list and have it signed and dated? I would copy it if you still have it. Send a certified copy to the manager with a copy to the owner. Give them a grace period to have everything fixed, say two weeks. At the end of the two weeks send them another copy. Keep a copy of everything that you do, including any receipts for certified or registered mail. Either one will work. You can also use a fax if they have a fax number. Take all of the copies of your efforts to landlord and tenants. That should wake them up a bit. The manager should have called your noisey neighbors for you, as you might have problems if you complain directly to them. He could possibly make it anonymous. Keep a log of their late nights with times and dates. Take it to him and ask him to call. Tell him that you do not wish to be known. Also, call the police the next time they choose to wake you up at 2AM/ There are violations against noise. Tell the police not to come to your door, as you do not wish for them to know that you complained. Good luck!

Sometimes the list is just to know what was broken or dirty before you moved in, so that they don't take it out fo your deposit when you move.

As for the neighbor, the landlord should be responsible for making them be more respectful to everyone in the building, and if not, call the police if it's bad enough, like loud music at 2 am (which we actually had the problem of).

I believe it depends on your state of residence. Get the policy book from the apartments. For loud noises, call the police and file a complaint. For some states if the repairs are a health/safety concern call the housing authority to complain. Send letters - not calls to the management office to complain and send them certified with a return receipt confirmation.
