What should i do i really want out my lease?


I moved into a 2 bedroom in reno and we have a newborn and 2 little girls,we contacted the office about roaches in our home and they did nothing and when we went back they said they never heard of no such thing,its been over 3 months and nothing also we had a man expose himself to a 14 year old girl in the washroom and the never kept the ppl posted on what happened.not only did this happen they had a hit and run with two cars right out side my bedroom window and no police came not even there gaurd that they say is walking around....I not only fear for my little girls but for the other kids around here and the roaches is just not clean or health ,if you think thats bad i went on my patio and someone had put a used condom right there where any kids can grab it......All i want is out my lease and i dont know how to do that cause everytime we go there they say write a letter or we should take it up with there lawyers what should i do

Aside from the roaches, nothing you mention is in any way the apartment owner's fault. They can't control people who live in or around the apartment. The thing to do about the roaches is to mail via certified mail a letter stating the problem with the roaches and that the problem is making the apartment uninhabitable.

Put EVERYTHING in writing and keep after them, also talk to a real estate lawyer

And only do month to month after this

You gotta read the lease carefully. And when you complain start doing it in writing, and send it to the place identified in the lease (normally near the end). You haven't described anything yet that would let you out of the lease, but you can do things that will make the landlord want you to go.

The next time you see roaches, call the health department and tell them your apartment is infested (use that word). It's probably not, but you are building your case, and as far as you are concerned, it is. When you hear the reports about the man exposing himself, call the police, and have them send an officer to talk to you. Let the landlord know you will keep calling the authorities until they straighten the place up, or until they let you move without penalty.

If you don't do it their way, and you move, they will be able to sue you for the rent left on your lease term.

Keep record of Everything, take pics even. Keep on them about everything as well and keep records of when and who you spoke to. Also, you can call the health dept. and see if they will come out for unhealthy living conditions.

I had a problem like yours once and i got out of my lease. The roaches make it an unfit place for your kids to be at. You need to write or type a statment that states you want something done about the bugs. Get that notorized and mail it to them and keep a copy for yourself. When you mail it send it where they have to sign for the letter. State in your letter that you demand something be done or they are breaking the lease themselves. Wait 30 days to be say then if nothing is done move out. If they take you to court which they won't but if they do take your letter and where they signed for it and show the judge tell him they didn't do anything about the bugs. The judge will throw the case out and the lease is no good.

call the board of health and make a formal complaint. see if infestation is a lease violation. call the police about the flasher and get it on record.

ppl. need to check these places out before they move into a roach infested hotel.

If the conditions under which you are living are really as bad as they seem, then:

get (notarized) statements of a few witnesses

document the conditions with photographs/video of the conditions; put a newspaper with that days date in some of the shots, to show what days you took the photos/videos

send a certified letter to your landlord telling him that you are moving out 30 days from [now]. Do NOT talk to his lawyers...his lawyers work for HIM, and will not give you advice that will hurt their client; tell him that you are leaving, and that if he wants to take you to court, than you will WELCOME the opportunity to show the statements and video/photos of the deplorable living conditions you have endured to a housing court/small claims court judge.

He will let you leave. Clean up as best you can before you go, fix up any cosmetic damage (document with photos/video with that days paper) so that when you request your damage deposit, he will not be able to keep it.

There is an implied warranty of habitability in many states and often a landlord's failure to remedy complaints can be grouds for release from your obligation. Sonetimes you can even claim rent during the period that the problem was not resolved, remember you are the legal owner of the property by virtue of your lease. As such, you have your own responsibility to remedy the problem for yourself if you can. Good Luck.
