Is there any way to stop my landlord from simply walking into my apartment?


I currently live with roommates in an apartment complex in Georgia. During the past few weeks, individuals from the leasing office have entered our apartment on two occasions without giving us any notice whatsoever. Also, on both occasions, there was no one home to be present while they were inside to supervise.

Aren't they supposed to give at least 24 hours notice before entering a tenant's apartment? I understand they have the right to inspect, but for them to just decide they want to use their copy of the key they have for our apartment and waltz inside seems totally out of the question.

When we went to the office to confront them about it they said they refused to speak to us on the matter.

Can anything be done?

According to this weblink, Landlords are not required under Georgia law to give notice before going in.

I recommend finding a local law person who is more familiar with rent laws. I also recommend on moving out from that area cause it seems like a landlord who is uncooperative (such as refusing to speak to you) can make your living situation like hell.

Well, maybe they were showing the apartment to prospective clients?

You can stop this by putting offensive items near the doorway, like turds in sealed bottles, gay (male) porn taped to the wall by the entranceway, etc. Just don't do anything actually illegal or unsanitary.

I had a dorm once,, only once,, never again, Fire regs required no cooking to be done in the room, On pest control day, my guy saw a hot plate in a unit. I mentioned it to the resident that night, and asked her to remove it. Next week I entered her unit and removed the hot plate, It was placed on some cardboard box.

No notice, and not feeling guilty, as I may have saved many lives from a stupid act.

NO landlord will enter your unit if he does not have a good reason, well most times any way. Look at your lease. some say notice needed, some do not. Mine says none needed. I tell the tenant that if the weather is bad I will check units. We had big ice storm last night, Today I entered and found one unit with not power due to Lines down. and Tree on the house.

You do not own the property.

They have every right to walk enter w/o notice in case of an emergency or suspected emergency.

The only thing you can do is buy your own property. Landlords have rights in every state.

Unfortunately Georgia Tenant Landlord law does not require a landlord to provide notice to you before entering. You'll have to check your local municipality regarding this, I've looked up your tenant landlord law and all it states is:

In regards to your situation this was the only thing that even mentioned entry by the landlord.

(a) Municipalities and counties may establish by local ordinance minimum security standards not in conflict with applicable fire codes to prevent the unauthorized entry of premises occupied by a tenant as a dwelling place and may require landlords to comply with such standards.

Not sure what can be done, but your right about the fact that they are suppose to give you 24 hours notice. Check with the district justice in your area.
