How do I get out of my lease if I am buying a house? |
I am currently in the closing phase of buying my first house. I am on a month-to-month lease with my apartment complex. Set to close on or before Feb. 14, but now my apartment complex is telling me I have to give them 30 day written notice that I will be moving. I have been upfront about my living situation with the rental office throughout this whole process and even signed a 3 month lease prior to the month-to-month rental. Are there no special circumtances such as this that would allow me to break my lease with little to no penalties? Why can't it be a courtesy for them to atleast back date my Intent to Vacate letter since this letter was not presented or even mentioned to me at the time that I paid my rent? There are no provisions or special circumstances to allow you to break your lease with little or no penalty because you are purchasing a home. Landlords issue leases for a reason, to get as much income from a property as possible, and you are bound by the terms of that lease. nope. you have to give them a written 30 day notice. this is very standard anytime you are moving. this doesn't mean you can't physically move out before the 30 days is up, but you are responsible for the rent through those 30 days. you are going to have to pay rent for all of Feb. NO U DONT HAVE ANY OPTIONS HERE BE PREPARED TO PAY FOR BOTH PLACES FOR a MONTH, if u dont the apt complex will probably go for a judgement against u and lein your new home, its not worth the agravation and grief to try and beat them out of it UNLESS THERE IS SOMETHING IN WRITING IN THE LEASE ADDRESSING THE PURCHASE OF A NEW HOME. if its not there u r stuck. sorry No. A 30-day written notification is very reasonable. The apartment complex is not responsible for the uncertainty on your closing date. As everybody said, you have to give them the full 30day notice, so you may be liable for the 15days extra. If you dont pay it (assuming you dont have a deposit with them) then they'll just throw it on your credit, even worse. No, there are no special circumstances simply because you are purchasing a house. You need to give written notice by the end of this month (January), so that your effective termination date is the end of February. You will be stuck with about two weeks worth of rent after your closing, and that's pretty normal. Give them a written 30 day notice today. That would put you at Feb 22nd. Thats 8 days past your closing date. Which is good. Gives you that many days to get all your stuff out, you dont have to stress about moving it all in one weekend or a day. You will only have to pay rent til the 22nd, they should pro-rate it for those days. |
