Can a suddenly widowed elderly woman break a lease.? |
My father passed away 2 weeks ago and my mother 82 years of age can not afford the lease . the rental office is telling her she can't break thr lease under these conditions. move her out. you may be liable for the remaining lease until they rent that space, then you should be off the hook. probably not and get away scot free. Is your mothers name of the Lease?? You know...she can do what she wants. If her name is on the lease no. A lease is just like a contract and she wont be able to get out of it unless the pearson that she has the lease through lets her out of it. Try to seek a legal representative. It's the law, if she is able to show proof stating that she's not able to pay rent anymore should get her out of the lease. If her and her Husband were both listed on the lease and she can't meet the monthly payments, then I don't see why she should be able to carry out the whole term. She legally cannot without their consent, that's if she is even on the lease. But ethically they should let her out of it. Just have your mother send a letter listing her move out date...She'll be out the deposit...and sometime down the road, the landlord could pursue her for what's allowed for in the lease. |
