When the maintenance worker breaks my thing?


A maintenance worker entered my place yesterday and did some bathroom work. My husband did put in a work order, but forgot to tell me about the order b/c he wasn't feeling well. We didn't receive any notice about the date/timing of the work.

I found that the worker had dropped my eyeglasses and broke the nose piece. I called the corporate office and asked them to send an email to my leasing office since the leasing office was closed when I called. No one has contacted me.

Am I still supposed to receive notices re: repairs I (or my husband) may have asked for? Can I ask them to replace the broken eyeglasses since the man actually broke it? My lenses are super high-indexed - I received a quote of $250 this morning just for the lenses, minus frames. Or is it our fault for not moving the eye glasses without knowing when they were coming?

Your request and them agreeing was notice. You knew they were coming because they were responding to you.

You are going to be hard pressed to prove that the glasses were not already broken or broke in some other fashion. A simple drop should not have broken them.

You would get further with your renters insurance company then trying to get the landlord to pay for them.

They do have a legal responsibility for damage to your property but the burden of proving that is your responsibility for any judge to view the case the judge must have proof that your claim is true .
Try to approach the apartment office staff with this problem and they may try to set things right for your good-will as a tenant should be important to them in the same way that their good-will is important to you .
Good luck with this one - you may need a lawyer . Also , go up the chain of command and speak with either the owner or management company and address this issue with them and they may replace your glasses or reduce your rent payment as a way of compensation . Remember who you talk to and when - remember that the burden of truth is yours ,
