Im trying to get out of my lease, neighbors are loud and the office hasnt done anything about it.?


I have written several letters to the leasing office and nothing has been done. I am willing to move but they want to charge me the rest of my lease to get out.

I have told them I want to end my lease and they want to charge me $2000 when If I was to stay there, I would pay only $1500.

I have been having problems with the neighbors since they moved in 3 weeks ago, they make the common hall smell like sick indian food, thier kids run up and down the stairs from the common hall and patio stairs, park thier car to where I cannot get into mine, walk around half dressed, cannot speak english, and dry thier clothes on my side of the balcony/patio!!!

legally i dunno if you can get out of your lease due to "bad" neighbors (i'm just guessing, i might be completely wrong). on the other hand, the management should take the responsibility to take your complaint seriously and if anything, the new residents should be given warnings that they have been receiving complaints, and if they don't comply, they should get evicted.

i know this because when i was younger, i was evicted because i used to have parties all the time at my apt and pissed off alot of other residents. i dont think the people i pissed off could get out of their lease but because they complained, i was evicted, lol.

What it's only like 2 months, just suck it up. None of those things are serious, they are minor annoyances. Only serious things like consistently loud noise after 10PM, letting criminals into the building, or open and obvious use of injectable drugs, is going to get them kicked out.

Were the letters sent by certified mail with Return Receipt Requested??? If not - write an Affidavit and send it to them certified mail - you can get it Notarized usually in a Court building - that is the place where all the crooks try telling innocent people they are crooks and exhort their money ...

Give them 3 days to do something about the problem ... maybe the people next door are tired of using your side the balcony for a clothes dryer and they cannot get out of the lease either ... Your problem is not so much with the neighbors - IT IS YOUR LEASE/CONTRACT you have problem with.

If no answer in 3 days - Send them another Affidavit telling them that you want out of your lease - UNLESS - they can show you in the lease that you were supposed to put up with unruly people living next door that infringe on your right "to the pursuit of happiness" ... and if they cannot show you this - you want the lease made null and void on GROUNDS OF LACK OF FULL DISCLOSURE.

Unless they can prove in the contractual agreement/lease - that you agreed to stay there when they moved in people that infringed on your rights ... then the contract is null and void and you want to know whether or not you should bring charges against them or whether they want to just cancel the lease.

You might even want to hit them up for some bucks to help you move - since THEY ARE THE ONES WHO BREACHED THE CONTRACTUAL AGREEMENT, not you.

The bottom line is ur contract, what is stated in it?
Do u have a right of termination in case of default by the landlord? If u do then u have to show that the "quiet enjoyment" clause has not been fulfilled by the landlord(or that the landlord did nothing after u complained about the noise-which can be taken as a breach of contract).
But if u have no such right under the contract, the best option would be to invalidated the contract, on the ground that (for eg) ur consent was vitiated,i.e, the place u were renting was presented to u as something else that what it was. (or mistake) But this would rest on how long u have stayed in this place.

Check your state's landlord and tenant act. Also, read over your lease agreement, there has to be a line in there regarding respecting your neighbors. I would document everything that occurs and then every time you notify management. You might have a case once you have compiled everything. You might check with a lawyer or something, or give them everything you have documented and tell them you will be contacting an attorney if they don't uphold their part. I had to do something close to this, except I was being "warned" for a loud dog, even though I had no dog. I kept all my documentation and took pictures of the apt across from me having her dog outside on her patio all day barking.

I can tell you that all the things you listed except the "park thier car to where I cannot get into mine" are useless. That is the only one that may be useful, the judge would just laugh if you brought up any of the others.


Honestly, this doesn't seem like anything more than a cultural misunderstanding. They are probably immune to the smell of their food, and in many countries it is normal to dry clothes on clothes lines (they probably figure that you aren't even using your side, so what's the harm). Have you tried talking to them about all this? Before you go out and file complaints and get lawyers involved, try to approach them in a friendly way and discuss the situation. You will be helping them adjust to America, and you may learn something about another culture as well.
