Breaking a 12 month lease?

Since my husband and I moved in this apartment things weren't going smoothily. This person responsible for our account was always screwing up. They requsted an allotment since my husband is in the military. The account number they gave us was incorrect every month. this has made us broke becuase we're always overdrawn bwcuase of their mistake. Since, the last month we have paid with another form. Now these last two months our plumbing is acting weird, and it took them 3 days to replace a heater. reminds you we live in VA and it gets cold at nite.On top of that we have neighbors above us that are consatantly running and yelling their floor is our ceiling , it makes it hard to sleep. We were wondering if these terms would be considered to break our lease? We are going to their office today and letting them know these issues.

You could use it but you would have to come to an agreement with the person with whom you have the lease with. You are technically breaking a contract. Keep in mind they might make you pay a portion of the rent or keep your security deposit. Whatever agreement you come to make sure it is in writing and notarized.

In most leases it states you have the right to peace and quiet, obviously you are not getting it. If they will not let you out of the lease, you may try calling the county and setting up an escrow account to pay your rent into. The landlord will not get it till they rectify your complaint.

Most apartments are run by comportations, so a great way to get your problem addressed it to find out what company runs your complex find thier website and email their CEO. Trust me, your issues will get addressed. If the email address is not on the website find out the name and send it to all possivle combinations @thecompany.com. For Example if his name is Bob Smith, try Bob@thecompany.com, BobS@thecompany.com and BobSmith@thecompany.com... one will work!

Most likely those issues would not constitute breaking your lease for breach of contract on their part. However, you could probably find a sub-leaser and then you could move on. Otherwise, your lease details what penalties there are for ending the lease early. I would say you have a case for expecting some action to get better service, but not to break your lease.
