Past Lease Problems...?


I leased a car in 2002, and turned it in at the end of 06 when the lease was up. Mileage was way over (I didnt' understand a lease when I signed) so anyway I owe for that. Now, I started making montly payments to them for the amount due in january/feb. Then I started recieving harrassing phone calls from a lawyers office threatening me with court and they would take everything i had etc. I lost my job the last time he called and I finally said whatever. I was told if I made an agreement no legal action would be taken...so I did. Now I have rec'd a FedEx with court summons over the amount due. Also stating a due amount from Sept 06 when I have been paying! What are my options?

i think you're going to have to get an attorney to get you out of this one.
You'll need to have a copy of your original lease, the amount you've been told you owe for the miles over, how much you've paid so far and proof of it. Bring all this to your attorney and let him battle it out.
It may be possible to counter sue, stating that your lease was not adequetely explained it to you.

None really, since you said "whatever" and accepted whatever they wanted to do. Pay the amount they are asking for.

You can try pointing out the amounts you have already paid, and send them copies of the receipts to prove the payment, and they may or may not subtract that from the total owed. Do NOT send originals, only copies.

Added for players benefit: "The lease was not adequately explained to me" is NOT a valid defense. It's assumed you can read, and won't willingly sign anything you have not read, and understood.

It's pretty simple. You drove the extra miles, you owe the money. I've never heard of a lease company accepting monthly payments for excess mileage charges. Sounds like you kind of did that on your own. The lease company has no procedure for handling such monthly payments, which is the basis for the problems you're having now getting them to acknowledge those payments. Now it's your responsibility to prove to them that the payments were made, and for you to pay them, in a single payment, the remainder of the charges.
