Break lease? |
Hi, I'm living in an apartment in suburb of Chicago, and i have seriously hard time with my upstair neighbor's noise. He plays guitar or piano all the time (He played after midnight too, but I had strongly complained and he doesn't play at that time on these days...) and makes sharp floor tapping noises. I have complained about 7 times to the aprtment office and two times to upstair guy too (At the time we complained all day long piano noise, he complained us too that our cooking smell is unpleasure to him because he doesn't cook at home and something mostly nonsense). But, nothing is improved that he still do samething everyday. I talked with the office worker, and she said that there are no laws for playing music instrument during the daytime. He plays piano about 5~8 hours per day. So, I decided to move out, but I have one year lease that I should stay until late October in this year. Is there anyway I can break the lease and leave earlier? Thank you... Get an attorney...it is possible that you have a claim that your landlord broke the warranty of quiet enjoyment...in this claim you are stating that the noise or other nuisance is so disturbing that a reasonable person would find the apartment near livable...your attorney will know ILL law better. File a complaint against the apartment owner for failing to provide livable conditions. That will get his attention. Find someone who is willing to sub-lease the apartment...they then take over the remainder of the lease at the rental rate that you are currently paying. There may be a fee to have this take place but it allows you to get out of your lease legally and without causing the landlord to have an empty unit or advertise to rent it out again...all costs that he could place on you. Read your lease to determine if Sub-letting, Sub-leasing etc is an option and then if it is, use it, but first discuss with the landlord before taking any action. |
