Breaking My Lease!? |
I live in Ohio and back in March I moved into this apartment mainly because I needed a place to live. When I moved in and looked over the apartment there were somethings that needed to be fixed. The leasing guy documented it down and said he would get someone over to fix the things. Well it is now November and no one has come to fix anything. I have called the office many times and they keep telling me they will get someone over but they have more important things to fix. I pay $689 for a small two bedroom apartment and its not worth the stress. I also have neighbors upstairs from me that pile their trash on their porch and it falls down infront of my door. i call the office about that and leave message after message. When I finally get in contact with someone about it they tell me they will send them a letter. A LETTER ARE YOU KIDDING ME!!!!!!!!! I want to get out of my lease who could I talk to or get advice from to get me outta here. I dont want to pay money to move out! HELPPPP!!! Well the fact is you are screwed unless you are willing to fight it. You can just move out and leave a letter stating the apartment management is in breach of contract and not following due neligence in getting problems resolved. State that if they black list your credit you will sue. breaking a lease scot-free is damn near impossible...I would write a letter to your management company detailing your repair needs and complaints...then place your rent in escow...your repairs will get done at least. Hopefully you didn't sign a 2 year lease...at this point I would just wait it out and start looking after the holidays. You're best option is to consult a lawyer. They can draft a letter for you to send to your landlord's office saying that unless action is taken to fix the issues then you are well within your rights to move out. Part of your lease should state that the landlord is responsible for providing a safe and habitable place for you to live and their inactions are definitely in violation of this. The letter shows you are serious and should be enough to scare your landlord into complying as most landlords will do anything to avoid lawsuits. Talk to a lawyer but for your own protection do write the letter explaining all your complaints and how many times you have called them hopefully you remember every date and time when you have called them, make a few copies and send the letter keeping at least a couple of copies of the letter. Also don't sound rude or be obnoxious it can be used against you if you decide to take them to court will I advise you do eventually. Take pictures of EVERYTHING that needs to be fixed including of the trash your neighbors pile up and falls in other words a before it falls and an after it falls.
