What are the for termination of a month 2 month lease?


I rented an office in Florida. Since I had previously rented a unit at this location for 5 years I moved in and waited on the owner to give me a lease. He never did, after about 4 months & $1000 in upgrades I get a letter sent to my home advising me that my month to month lease was being terminated and that I should leave in 5 days. I wasn't given 30 days notice (should I have 30 days notice)? I took all of the shelving that I put on the walls down and I repainted the walls. I was in the process of removing the paint that someone put on the cement floors(that was chipping badly because the floors weren't sealed). In 4 days they were to be acid washed and stained. I was not able to get all of the paint off of the floors before I received the termination letter and I didn't repaint them either. Time didn't allow this to be done and there was no such preparation done prior to my moving in. I was given $56. of my $400 security deposit. What does legal say in this regard? Help!!!

Either party must provide notice at least this far in advance of the next rent payment date in order to terminate the lease. This means that with a month to month lease, if either party wants to end the lease October 1st, they must notify the other party on or before September 15th. If one party gives notice on September 17th, that party cannot end the lease, without the other party's agreement, before November 1st.

You had to be given 30 days notice (in my state at least). About the security deposit -- you probably can't do anything to get back the rest of the money unless you sue the landlord. But the landlord should give you an accounting of what hte security deposit when to. Next time be sure to sign a lease so you have rights!!!

they should have given you noticePERIOD. there was no excuse for his actions. also he should have given you something for the month to month lease not just let you assume that everything was okay.
it sounds to me like the landlord is an idiot. i would def. fight this somehow sorry to sure on how:(
