Is there ever a time to renege on a lease? Only 24 hrs after signing, didn't want to go through with it?


After signing and leaving the rental office Fri, someone I purposely moved away from for harrassing me spotted me there. The office was closed so I came back on Sat asking to opt out due to the forementioned, I was told no. I'm having a hard time contacting the Property manager, esp. wknd and holiday, I haven't stayed in that prop since signing or anything. I need advice wether there is a period from signing and changing mind for valid reasons.

A contract is a contract. You can check with your state to see if they have a cooling-off period where you can nullify a contract, but I've never heard of that applying in real estate transactions.

You can certainly try dealing directly with the property manager to see if they will let you get out of it. If you have a restraining order against that person I'd certainly mention that, and I'd tell them allllllll about it. A smart landlord wouldn't want the trouble that would bring...

Otherwise you will be liable for the rent for the term of the lease.

There isn't a period to "change your mind". Your signature was a promise and they will hold you to the agreement you signed.

So expect to pay the rent or sublet.

I've never heard of any opt out period.

However, you are not necessarily responsible for paying rent for the entire duration of the lease.

In ALMOST every state (there are exceptions), if you default on a lease, the landlord is required to make a good faith effort to rerent the unit. This is called "mitigating damages." You will then be legally responsible only for the months that the unit was actually vacant.

If you have some friends that might be interested in this apartment, I would suggest introducing them to the property manager.

Since you actually signed the lease, I don't think there is a "buyer's remorse" period - especially since you asked and they said no.

However, here's a thought. Why let that other person keep you from living where you want to live? By doing so, you're basically letting them rule your life. If they are harrassing you that badly, I'd get a 50(b) aka RESTRAINING ORDER and tell them to kiss it. Don't let some stupid joker run your life, ok? If they bother you, call the cops! Don't live in fear.

Sorry, you signed the lease, you have to live there or find someone to take over your lease.
Get a restraining order.

well if someone is harassing you get an order of protection.
