Tenant Rights in Houston,Tx?
My fiancee and I live in Houston,Texas and got married today. We also have a daughter who is a month old. He has had an apartment which he just renewed his lease with for 2 years. Now the apt has new management. I live with my mom.I called the leasing office today and she said even though we're married and hes currently under a lease I fill out an application like I'm applying for an apartment. So I have 2 questions 1. Since we married today can I use my married name on the application or do I have to wait until I've changed my name with the social security office and DPS? Also she said even though we're married if I stay there for more then three days he will be given 24 hours to vacate. I thought when a couple is married they only have to fill out one application since they are married. I have no problem doing the application and appliation fee but can they legally evict him for his wife living there? I asked for the property management company and they refuse to give it 2 me.

Technically they can evict him only because when he renewed his lease you were not married. I would wait to use your married name until you have changed it with the social security dept, because it will not come up as the married name and you will not be approved. It takes time for the license to go through and there wont be a record of your name. Also technically they cant evict you in 24 hrs., they would have to give him a 30 day notice.
