Tenant Rights in Houston,Tx? |
My fiancee and I live in Houston,Texas and got married today. We also have a daughter who is a month old. He has had an apartment which he just renewed his lease with for 2 years. Now the apt has new management. I live with my mom.I called the leasing office today and she said even though we're married and hes currently under a lease I fill out an application like I'm applying for an apartment. So I have 2 questions 1. Since we married today can I use my married name on the application or do I have to wait until I've changed my name with the social security office and DPS? Also she said even though we're married if I stay there for more then three days he will be given 24 hours to vacate. I thought when a couple is married they only have to fill out one application since they are married. I have no problem doing the application and appliation fee but can they legally evict him for his wife living there? I asked for the property management company and they refuse to give it 2 me. call the Houston Apartment Association tomorrow. I think they can make you apply. They can rent to whoever they want to. The lease probably says he can't move people in w/o them signing the lease. Therefore he would be violating his lease and they could evict. From their point of view what if you two seperate and he leaves you there and if you don't pay the rent then they can't evict you because you didn't sign up. Also just because you marry him doesn't prove to them that you arn't a wanted criminal. They want to check you credit/backround. As long as you said you don't mind signing the agreement, just play by their rules. You don't want to start problems with the management. Your life is so much easier when they like you. Just ask them what name to use. |
