Can my apartment complex sue me?


I had two ceiling leaks in my unit. After I told the leasing office about the first leak several times, they would not respond. After 6months of repeatitly complaining about the leak, I went to the municipal building. The women in charge of building inspections said they have two weeks to respond. If they do not respond then they are in violation of the law. The woman agreed that my leak was a problem that maintenance must fix. The building inspections woman called up my apartment complex about the problem and they fixed the leak immediately. A few months later, water start dripping from the living room ceiling. I sent the leasing office a notorized letter and they did not respond within 2weeks. I complained about the leak to the same woman at the municipal building and she called the apartment complex. After that, the landlord, maintenance and the office manager came into my apartment.

The landlord said he does not like me complaining to the municipal building and I do not pay him enough to tolerate my BS Anyway, maintenance fixed the leak.... I live in an apartment complex in the New Jersey. If my apartment complex loses business then can they sue me?

Anybody can sue you for anything. Whether or not they win or lose is another story.

They can sue--they will lose. They are required to abide by the law, and if they retaliate against you, they are breaking more laws.

Anyone can sue anyone for anything, can they sue you - Yes.

Do they have any grounds - NO

Can you counter sue for retaliation - YES

They can sue, and they will lose.

And, given that you've had a governmental agency take action against them, you could countersue for harrassment, and likely win. They know this, their lawyers know this, and for this reason, they won't sue.

But, they can threaten to sue in the hopes it will shut you up.

I will state that, unless your lease gives you the sole option of renewal, that they will not renew your lease -- they want you gone. So, might start thinking of where you want to live next.

In New Jersey, if a landlord retaliates against you for going to the authorities, you probably can countersue and get double or treble damages. If they sue you then you must hire an attorney to make sure you have protection and to successfully file your counterclaim. Get something from the municipality to prove you filed a complaint with them on the specific days.
