Eviction from apartment?


About 9months ago, there was a leak in my apt. I called the leasing office about 10times within a 6month period and maintenance did not respond. Finally, I went to the authorities at the local municipal building and the authorities contacted the manager of my apartment complex. After that, maintenance immediately fixed the leak. About two months after that, another leak appeared in my living room. I sent a notorized letter to the leasing office and maintenance did not respond within a legal time frame. I went to the authorities and they called up the manager. Maintenance and the manager were at my apartment when I arrived home. They both said there was a leak. I had 5 containers directly under the water damaged part of the ceiling. One was about 6gallons full of water from the leak. They left my apartment and I got into the shower. I got out of the bathroom and the landlord was in my living room. He asked me where the leak was and I pointed to it. Basically, he said I am a dellusional

troublemaking tenant. After that, he said you are evicted twice. He wants to evict me because my apartment was too messy. It says in my lease that a tenant's unit must be kept as clean as possible. My apartment could of been cleaner. There is a lot of space to walk, no food is on the floor, appliances, trash is taken out daily, the bathroom sink, toilet and shower get cleaned once a month. I maintain the apartment to the best of my ability. Maintenance has the right to come into my apartment whenever they want to because I gave them permission to at the office. But, maintenance instaneously came into my apartment and the landlord expected right angles. This is unreasonable. What are my rights regarding eviction in the state of new jersey? How does the landlord evict me?

Hello. I am in NJ too and have had some landlord problems.

First off, the landlord cannot evict you without cause. Second off, he has to get a Sheriff's Eviction order. He cannot evict you himself. That is called a self help eviction and it is illegal in NJ.

Your best thing to do is speak to a Landlord/Tenant lawyer. You can find one in the yellow pages. They are not expensive and they are better suited to handle the situation. I paid less than $100 for mine and you do not need the stress or the headache. As soon as your landlord hears from your attorney, they will stop harassing you.

If you have all this in writing, put it in a folder and take it with you to see the attorney. They will better be able to tell you what rights you have and how best to proceed.


(I also had problems with my landlord saying my apartment was too dirty. They even had the local authorities come in and inspect my apartment who agreed with the landlord. However, I was given the chance for a second inspection because the first one was done when I wasn't home and without my consent. When I spoke to the inspector, he realized my landlord was harassing me. I am still in my apartment although my landlord has tried to evict me over half a dozen times.)

What was the question? If you don't feel you should be evicted, request a show cause hearing within days of receiving the magistrates "application for ejection" notice. I hope you have photos.

You can easily fight this eviction by claiming that you are being wrongfully evicted as a retaliation from landlord.

first what is the second reason the landlord is going to evict you?

In general in my opinion you have a very good chance to win, but you must show up in court on the eviction hearing to present your side, if not you loose

Two things on the eviction for the condition of the unit, it sounds like the landlord has a very subjective standard for the condition, i would take lots of pictures to show your side, as long as no food laying around i would believe it will be a long shot for your landlord to win

also in NJ, in order to evict for a lease violations, the landlord must send you a notice to cure, within the notice it must outline exactly the violation in specify, then must wait 30 days if you cure the problem eviction is stop, then after 30 days then move most of the time in NJ which is a just cause state for eviction it better be a major lease violation to prevail

just remember take pictures, get one of those disposable camera and start documenting, if served show up to court with the evidence
