What constitutes "permanent fixtures"?


In reference to a lease on a building for commerical (office)purposes what can be removed? Specifically, a chain link fence, security doors, alarm system and telephone system all installed and paid for by the tenant.

PERMANENT FIXTURE WOULD BE THE CHAIN LINK FENCE, SECURITY DOOR.

NOT PERMANENT FIXTURE TELEPHONE EQUIPMENT (WIRING IN WALLS REMAINS INSTALLED) SECURITY SYSTEM (WIRING IN WALLS REMAINS INSTALLED).

IF ANY COSMETIC DAMAGE WOULD RESULT FROM REMOVAL OF ALARM SYSTEM ACCESSORIES IT HAS BEEN MY PAST EXPERIENCE THAT ABANDONING THE WIRING AND SWITCHES WILL SAVE ANY FUTURE TENANT A LOT OF EXPENSE AND IT IS NOT WORTH THE TIME AND EXPENSE OF TAKING OUT THE MAGNETIC SWITCHES ESPECIALLY IF POTENTIALLY THE PROPERTY OWNER LOOKS UPON THEM AS AN IMPROVEMENT WORTH N0MINAL $50.00 -100.00 CREDIT TO OFFSET SOME OTHER CHARGE, JUST A SUGGESTION!

FENCE AND DOOR BELONGS TO THE BUILDING PERIOD.

OTHER IS CONTENTS BELONGS TO THE TENANT.

Anything attached to the building or grounds is a fixture. The fence and doors are definitely fixtures. The alarm system probably is. Depending on how sophisticated it is, the telephone system might be as well. Wires running through walls or a big switch box screwed to the wall of a telephone closet are fixtures. But the phones on the desks aren't and without them most of rest of the phone equipment will be pretty useless.
