Landlord/Termite issue at our office? |
We found termites in our office, the bug man said not much damage has been done, and they probably came in thru a crack in the foundation. Landlord/Property Manager said it was our responsibility....the lease doesn't mention termites, just structural vs. interior....am I responsible for paying for treatment and prevention? Assuming that the structural vs. interior distinction is landlord= structural and interior=tenant, I would say that this is a structural problem. The real problem here is whether he is going to try to say that you are responsible for any damage to his building when you move. I would get a certified contractor to do an inspection and try to determine where the termites originated. That would help your case immensely. The damage from wood boring insects can be devastating so you need to protect yourself if your landlord is going to try to say this is your fault. After that, I would consider moving my business if that is at all possible. Sounds like a terrible property manager. This is most certainly NOT your responsibility. I would make him fix the problem. He should want to fix the problem ASAP to protect his investment. If the building and conditions got worse, what good would that do him? If they are coming in through cracks in the buildings foundation I would deem that as the Landlord's responsibility to treat for you as it can spread and effect more areas of the property. |
