Can i sue a landlord for accusing us of illegal activity?


Here's the issue, my hubby and i lived in these apartments for a little over a year with my stepson with us for the summer and the landlord accused my stepson and his friends of illegal activity. My stepson is 13 yrs old his friends are 13,14,15. They were walking around the complex talking, hanging out and one of his friend's friend pulls up in a car to say hi, they gave each other 'dap' (like a handshake), the landlord sees that and instantly thinks it's a drug transaction. He gave us a violation, we went and talked to him in the office. He said, 'if someone is bumping their music in the car real loud and pull up to someone they are a drug dealer'. That ticked me off because that was a racist remark. He based his assumptions on that. He says he know what he saw. We haven't caused any problems ever. My hubby did get upset and started yelling, the landlord said 'he will end our lease with no explanation' and kicked us out the office. What rights do we have? Can he do this?

Yes he can.

He can refuse to renew the lease, just because he doesn't like your hubby or your son's friends. Terminating the lease before it is over is much more difficult. As to the accusation, unless he goes around telling other people that your son is in fact a drug dealer, there is no slander.

Oh goodness..This is awful. You have to violate the terms of your lease to be evicted..read your lease carefully.

What he was doing was stereotyping, not really racism, but I get your point.

1. Not everything said is racist. What he said was a generalization, but that is not the same as being racist.

2. In this day and age, when a group of kids pulls up in a car, radio blaring, and daps....most people think that there are drugs involved. Right or wrong, this assumption comes from the fact that often drugs ARE involved.

3. Bumping music in an apartment complex is nasty for everyone else who lives there. If your son is blaring his music or hanging out with people who do....people in your complex are not going to be too sympathetic. People have a right NOT to have to hear other people's music.

4. Since you weren't there....you have no idea what he saw. Your son may be innocent, but that doesn't mean that someone else in the car wasn't selling drugs.

5. Most states have anti-aggression laws that will allow a landlord to terminate a lease if the tenants have behaved in a threatening or aggressive manner. If your husband is yelling at the man or you are calling him a racist, he has every right to fear for his safety and take steps to terminate your lease.

6. He didn't accuse YOU of illegal activity; he accused the kids hanging around with your son of illegal activity...not the same thing. Maybe you should keep a better watch on a 13 year old kid that is "hanging out" with older kids who have cars, loud stereos, and no respect for the neighborhood. Don鈥檛 you think that it would be most responsible to take his comment seriously and talk about it with your son?

The best thing that you can do is apologize for getting out of control and promise that guy that you will keep a better eye on your kid. If you act like a grown up and a parent, he will be less inclined to look to remove you.
