Not telling him about court date..Wrong? but does anyone know what would happen if he doesnt appear You aren't obliged to tell him. He is required to provide his address to the court. That's HIS responsibility, not yours. It would be a decent thing to do, but if he's a butt head, don't say squat to him, just show up yourself. unfortunatly yes it would be wrong asimple call or note in the mail would clarify the date and will make u look better in court if he is truly that bad you may be able to prove somehow that he is an unfit father and any visitation he has with the kids will have to be supervised i personally dont understand how one could not love there kids more than themselves i would gladly give my life or kill so that my wife and my 2 gilrs could go on as far as a 3 month old knowing anything besides mom and dad eat ,sleep or play you are right he sounds like a dumbass ! if he doesnt show he may have given up the rights as a parent right there you will have to check with a local attourney they will be able to tell you If the service of notice is proved, ex-parte order is liable to be passed. You don't have to tell him he is responsible for getting his own mail even if he has to take his lazy butt over to his sister's to get it. I think if he doesn't show up though they will just make a new date and send out a new letter. You divorced him right? Well, then you are not responsible to take his hand and lead him throughout this process. Listen, the court has multiple ways of making sure that people know about the court date. They just don't tell you, but tell your attorney. If your attorney doesn't contact you and remind you then they should be fired. It's not your responsibility unless it would benefit you that he be there. In this case it might! If he doesn't show, his attorney might claim the court failed in it's attempt to locate him and notify him of his responsibility to be there, next thing that will happen is the date will be set back until he is notified. You may have to take off work again and waste a perfectly prosperous day. Trick is to get your attorney involved now so he will send a notification too! This way in court "he" can come back with he also sent notification to several residences to get him here on time. Now you are looking good. Finally, let me tell you this, I was advised to not be a nice guy in my divorce, my attorney said to "metaphorically" go for the throat! I did and got custody of my kids. She paid me child support. I was the one who decided what went on with the kids. It is imperative that you get in that position by any means available! Here all you have to do is warn your lawyer, and sit back and wait. In my experience the court is going to require proof that he was served the paperwork. If he wasn't served then it is likely that the court hearings will be continued, meaning that they'll just be rescheduled and you'll have to appear at a later date. If he isn't served the paperwork they aren't going to make a judgement in his absence. Not telling him, or giving the court the proper address is just going to waste a lot of time, and forestall your child support payments. Good luck! |
